TV Cast Terms of Use

1. The agreement

These terms are a contract between you and Zyveroq OÜ, Estonia ("we", "us"), about the TV Cast iOS app and this website (together, the "Service"). By installing or using the app you accept them. If you do not agree, do not use the app. Our Privacy Policy explains how we handle information and forms part of these terms.

2. What TV Cast is

TV Cast lets you mirror your iPhone screen and play photos, videos, web videos and IPTV streams on a smart TV or streaming device connected to the same Wi-Fi network. It includes a web browser for finding videos to cast and a movie advisor that suggests what to watch, powered by artificial intelligence models from a third-party provider.

TV Cast is a tool for showing content on your TV. It does not provide films, shows, channels or any other content of its own. The app changes over time; we may add, alter or remove features, and some features are available only with a subscription.

3. Who may use the app

You must be at least 13 years old, or the age at which you can consent to a digital service where you live if that is higher, to use the app. If you are under 18, a parent or guardian must agree to these terms on your behalf and must approve any purchase. You may not use the app if the laws of your country forbid it.

4. Compatibility and what to expect

TV Cast works with many TVs and streaming devices, but not with every model, firmware version or network. In particular:

5. Protected content and third-party apps

Many apps and streaming services use copy protection (DRM) or block screen recording. When they do, their content will appear black or will not play on your TV. TV Cast does not bypass copy protection, paywalls, access controls or geographic restrictions, and you must not use it to try. Some websites do not allow their videos to be played outside their own players, and the app respects that.

6. Subscriptions, free trial and payment

Some features need a TV Cast Premium subscription. The app offers a weekly plan and a yearly plan. Prices are shown in the app before you buy and may differ by country.

7. Content you cast

You are responsible for what you show on your TV with the app. Only cast photos, videos, websites and streams that you have the right to watch and to show, and follow the terms of the services they come from.

8. Movie advisor suggestions

The movie advisor's suggestions are generated by a machine. They can be inaccurate, out of date or unsuitable for you, and a title may not be available where you live. Check ratings and age suitability yourself before watching. We may decline to answer a request that breaks our provider's content rules.

10. Our intellectual property

The app, its design, code, name and logo are owned by us or our licensors and are protected by copyright and other laws. We grant you a personal, non-transferable, revocable licence to use the app for your own non-commercial use under these terms.

11. Trademarks and no affiliation

TV Cast is an independent app. It is not affiliated with, endorsed by or sponsored by any TV manufacturer, streaming device maker or video service. Names such as Apple, AirPlay, Apple TV, Google, Chromecast, Android TV, YouTube, Roku, Amazon, Fire TV, Samsung, LG, Sony, TCL, Hisense, Philips, Panasonic and Vizio are trademarks of their respective owners and are used in the app and on this website only to identify the devices and services the app can work with.

12. Third-party services

The app relies on Apple for purchases and on other providers described in the Privacy Policy for analytics, subscriptions, the movie advisor and hosting. It also communicates with your TV and its software, which are made by others. These services are governed by their own terms, and we are not responsible for how they work or for changes their owners make.

13. No warranty

The Service is provided as it is and as it is available. To the fullest extent the law allows, we make no promises that it will be uninterrupted, error-free or secure, that it will work with your TV, network or content, or that the app will meet your needs. You use the app at your own risk. Where the law gives you warranties that cannot be excluded, those warranties apply and nothing here limits them.

14. Limitation of liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special or consequential loss, for lost profits or lost data, or for damage caused by content you cast or websites and services you use through the app. Our total liability to you for all claims together is limited to the amount you paid us for the Service in the twelve months before the claim arose, or, if you paid nothing, to fifty euros. Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited under the law that applies to you. If you are a consumer in the European Union or the United Kingdom, the mandatory consumer protections of your country of residence remain in force.

15. Your responsibility to us

If a third party brings a claim against us because of content you cast or because you used the Service in breach of these terms, you agree to cover the costs, losses and reasonable legal fees we incur as a result, and to cooperate with us in handling the claim.

16. Ending the agreement

You can stop using the app at any time and delete it from your iPhone. We may suspend or end your access if you breach these terms, if the law requires it, or if we discontinue the Service; in the last case we will give reasonable notice where we can. Ending the agreement does not entitle you to a refund for a period already paid, except as Apple's rules or the law provide. Sections 7, 10, 11, 13, 14, 15 and 18 survive termination.

17. Terms required by Apple

These terms are between you and us, not Apple. Apple is not responsible for the app or its content and has no obligation to maintain or support it. Your licence is limited to a non-transferable right to use the app on Apple devices you own or control, as the App Store rules permit, and may also be used by other accounts in your Family Sharing group where the app allows it. If the app fails to meet any warranty that applies, you may tell Apple and Apple will refund the purchase price; Apple has no other warranty obligation. We, not Apple, handle any claim relating to the app, including product liability, legal compliance and consumer protection claims, and any claim that the app infringes someone's intellectual property. You confirm that you are not in a country under a United States government embargo or listed as a prohibited party. You must also follow any third-party terms that apply when you use the app. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

18. Governing law and disputes

These terms are governed by the laws of Estonia. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live and may bring claims in its courts. Before going to court, write to us; most problems can be sorted out by email within a few weeks.

19. Changes to these terms

We may update these terms when the app or the law changes. The current version is always at this page with its effective date. For changes that matter to you we will tell you inside the app before they take effect; continuing to use the app after that date means you accept the new terms. If you do not, stop using the app and cancel any subscription.
